Users

Although the access and/or use of the portal does not require the registration of the users, it is possible that the use of certain services is conditional to the prior completion of a registration form and the use of an access code comprising a user code (login) and a password, which shall be received after having completed the registration process.

Thus, in relation with the registration process and the data that is requested, the user is obliged to facilitate and maintain the information in a true, accurate, current and complete form concerning his identity, and must communicate any modification to HOFMANN NUTRITION AG. Furthermore, the user commits to make diligent use of the user code (login) and password, not to make them available to third parties and to notify HOFMANN NUTRITION AG. in the event of their loss or theft and the possible access to them by third parties, the user being the sole person responsible until the aforementioned notification to HOFMANN NUTRITION AG.

Intellectual and industrial property

This Website is the property of HOFMANN NUTRITION AG.

The user acknowledges that HOFMANN NUTRITION AG. is the exclusive owner or holds the corresponding licence for the content of this Website, that is, and including but not limited to the texts, messages, photographs, designs, logos, source code, graphics, images, drawings, audio, video, computer programs, multimedia products, “look-and-feel”, the brands, commercial names and distinctive signs that appear in the same.

The access to this Webpage by the user does not imply any type of waiver, transmission, total or partial transfer of the licence to the said intellectual and industrial property, neither does it confer any rights of utilisation, alteration, exploitation, reproduction, distribution, public communication, transformation, etc., without the prior written consent of the respective owners of the said rights.

The user is authorised to access, view, print, download and store the content and/or elements of the Website exclusively for his own personal, private and non-profit usage, that is, with no commercial purpose, as long as he maintains the indication regarding the origin of the same and the copyright symbol and/or the intellectual property notes of the owners.

The sending of information to the portal or to the company itself by the user, via email, fax, post, forms or any other means, implies by this simple fact the granting to HOFMANN NUTRITION AG. of a free, non-exclusive global licence, for the entire time period enabled by the legislation in force, for any purpose, including and not restricted to the reproduction, public communication, distribution, transformation, translation, divulgation, rejection or deletion of the data, the publishing, incorporation into databases, the commercial exploitation, in whatsoever format, means or technology currently known or that may be known in the future, wholly or partially, regarding such information and content, a licence that shall enable the authorisation to incorporate and commercialise such content in supports such as CD-ROM, DVD, the Internet, paper and others. The user also grants the right to cede or sub-licence the said rights to third parties.

The user assumes the responsibility that the information and/or content sent does not infringe the rights of third parties or contravene any of the regulations in force, or involve confidential information and also assumes the obligation to maintain HOFMANN NUTRITION AG. and/or its representatives, partners, managers, proxies, employees, etc. harmless and exempt from all liabilities that may arise from the exercise or actions, legal or otherwise, originating from the infringement of third party rights or the legislation in force.

The user commits not to delete or alter the notices such as copyright, © and TM that appear on the Website, on any of the materials contained in it, in any of the services or information obtained through the same, in order to ensure the protection of the said rights.

Use of cookies

With respect to the use of Cookies, HOFMANN NUTRITION AG. informs the user that cookies are used when he browses through the different screens and pages of this Website. Cookies are small text files that the server can save onto the hard drive of a computer to store some kind of information about the user. The cookie can only be read by the Website that sends it to the computer. It is not an executable file and cannot propagate content or viruses. HOFMANN NUTRITION AG. uses this data with the ultimate goal of improving its services. The information that is stored by this mechanism enables the user to be recognised during his different visits to the Website, as well as facilitating information on the date and time of the visit, measuring some traffic parameters within the Website itself and estimating the number of visits made, enabling HOFMANN NUTRITION AG. to inform, focus and readjust the services it offers in the most effective way. The cookies used are stored on the user’s hard drive, but the data contained in them cannot be read and the cookies files created by other providers cannot be read either. The cookies are neither invasive nor harmful and can be deactivated by means of the corresponding action that appears in the browser.

The User agrees that the use of the portal, the contents and/or the services is carried out under his sole and exclusive responsibility and that HOFMANN NUTRITION AG. does not guarantee that the information is exact, complete or current; there is no responsibility whatsoever concerning the availability and continuous functioning of the same, or the contents and/or services that are incorporated; nor does it monitor or guarantee the absence of viruses or other elements that may result in alterations in the computer system or the electronic documents and files stored on his computer system.

HOFMANN NUTRITION AG. excludes, in all extension authorised by the legal provisions, all liability for damages of any kind that may be attributable to the information in the portal and the lack of availability or continuity of the portal and the contents and/or services incorporated into it.

Interruption, suspension and cancellation

HOFMANN NUTRITION AG. will make all reasonable effort to guarantee the accessibility and availability of the portal during all the days of the year. However, it reserves the right to alter, delete, interrupt, suspend and/or cancel the access, the services and/or the contents of the portal without the need for prior notice, at any time.

Applicable law and jurisdiction

The present general terms shall be construed and applied in accordance with the Spanish legislation, to which both parties are subjected expressly. If the regulations enable the parties to renounce their own legislation and be subjected to another, HOFMANN NUTRITION AG. and the User, expressly waive any other legislation that may be applicable to them, subjecting themselves to the Courts and Tribunals of the city of Bützberg.
